January 16, 2019 - The Administrative Law Judge concludes that the Agency violated Petitioner’s rights under the Veterans Preference Act, Minn. Stat. § 197.455, by failing to post a newly-created position which would have allowed the Petitioner to compete for the position. Therefore, the Administrative Law Judge respectfully recommends that the Commissioner order the County to open the ESS position currently held by Mr. Frie to the competitive application process, and allow the Petitioner to compete for the position in accordance with the Act, along with any other candidates who wish to apply.
