8-1801-35687 In the Matter of the Appeal by Amanda Pipes of the Order of Temporary Immediate Suspension

November 29, 2018 - While the source of the injuries to K.T., a child who was enrolled in Ms. Pipes’s day care, was not firmly established during the evidentiary hearing, the Department did demonstrate that it had reasonable cause to believe that K.T. was injured as a result of being grabbed in the face by Ms. Pipes. Under our law’s reasonableness standard, there is sufficient cause to believe that Ms. Pipes’s actions or failure to comply with the law pose an imminent risk of harm to the health, safety, or rights of persons served by the program. The Commissioner of the Department of Human Services (Commissioner) should uphold the Order of Temporary Immediate Suspension until a thorough investigation can be completed.
