November 6, 2018 - Because the violation was the proximate cause of the death of an employee, it was properly classified as serious under Minn. Stat. § 182.651, subd. 12, and the proposed penalty of $25,000 is mandated under Minn. Stat. § 182.666. The Administrative Law Judge, therefore, respectfully recommends that the Commissioner of the Department of Labor and Industry (Commissioner) AFFIRM the citation and proposed penalty.
