80-1801-35513 In the Matter of the Appeal by Mario and Lidia Saldana of the Order of Temporary Immediate Suspension of their Group Family Child Care License

October 15, 2018 - The Administrative Law Judge concludes the Department has failed to demonstrate that there is reasonable cause to believe there is an imminent risk of harm to the health, safety, or rights of the children in the license holders’ care sufficient to allow the TIS of the child care license to remain in effect while the Department completes its investigation. Because the Department has failed to meet its burden of proof, the Administrative Law Judge respectfully recommends that the Commissioner rescind the TIS of Mario and Lidia Saldana’s group family child care license.
