September 12, 2018 - The Administrative Law Judge finds that the Department has established by a preponderance of the evidence that Appellant is responsible for maltreatment of a minor by neglect under Minn. Stat. § 626.556, subd. 2(g)(3). As a result of that maltreatment determination and a prior maltreatment determination in 2014, Appellant has committed “recurring maltreatment” and is disqualified from having direct contact with, or access to, persons served by the programs licensed by the Department. Because the Department properly determined that Appellant poses a risk of harm to the children in her care, the Administrative Law Judge recommends that the Commissioner deny a set-aside of Appellant’s disqualification. Based upon the two maltreatment determinations, the resulting disqualification, a violation of a variance previously granted to Appellant, and other licensing violations, the Administrative Law Judge further finds that the Department had reasonable cause to revoke Appellant’s child foster care license. Appellant has failed to establish by a preponderance of the evidence that she was in full compliance with the laws and rules that the Department alleges Appellant violated at the time the Department alleges the violations occurred. Accordingly, the Administrative Law Judge respectfully recommends that the Commissioner affirm the revocation of Appellant’s child foster care license.
