June 11, 2018 - The Administrative Law Judge concludes that the County demonstrated by a preponderance of the evidence that Licensee committed maltreatment by neglect in September 2016, and that the maltreatment was recurring, but not serious. The Administrative Law Judge therefore recommends that the Department’s resulting disqualification of Licensee be affirmed. Furthermore, the Administrative Law Judge concludes that Licensee failed to demonstrate that she was compliant with applicable licensing laws and rules at the times the Department alleged she was in violation of such laws and rules. Therefore, the Administrative Law Judge respectfully recommends that the Commissioner of the Department of Human Services (Commissioner) affirm the order revoking Licensee’s foster care license.
