March 23, 2018 - The Administrative Law Judge concludes that the Department has proved by a preponderance of the evidence that it overpaid Appellant $2,166.25 for adult day care services that Appellant provided to three individuals on March 1, 2012 and August 26, 2013, and that the Department is entitled to recover $2,166.25 from Appellant for that overpayment. Therefore, the Administrative Law Judge recommends that the Commissioner AFFIRM the Notice of Overpayment issued on May 22, 2017.
