January 25, 2018 - The Administrative Law Judge concludes that the Department has established by a preponderance of the evidence that Appellant committed “abuse” by repeatedly submitting inaccurate timesheets for the provision of personal care assistant (PCA) services in violation of Minnesota law. In addition, the Administrative Law Judge concludes that a two-year suspension is an appropriate sanction for this conduct. For these reasons, the Administrative Law Judge recommends that the Commissioner uphold the Notice of Suspension issued to Appellant.
