71-1800-34682 In the Matter of the Appeal of the Order to Pay a Fine and Order of Conditional License of the Family Child Care License of Jillian D'Aigle

January 5, 2018 - The Administrative Law Judge determines that the Department had reasonable cause to issue the Order to Pay a Fine and Order of Conditional License, and that Licensee has not shown by a preponderance of the evidence that she was in full compliance with all rules and statutes governing her family child care license. Therefore, the Administrative Law Judge recommends that the Commissioner of Human Services (Commissioner) AFFIRM the Order to Pay a Fine and Order of Conditional License. Based on the facts of this case, however, the Administrative Law Judge recommends that the Commissioner AMEND the Order of Conditional License to remove items related to behavior guidance and to impose a term of less than the two years originally imposed.
