January 4, 2018 - The Department issued the Order of Temporary Immediate Suspension solely because Ms. Garner’s eight-year-old son displayed troubling behaviors while living in the daycare home. The Department believes the child poses a risk of harm to the children to be served by Ms. Garner’s daycare program. The credible and unrebutted evidence, however, is that Ms. Garner’s eight-year-old son, now lives with his grandparents in southern Minnesota, approximately three-and-one-half-hours away and poses no risk of harm to the children in the daycare. Therefore, the Administrative Law Judge recommends that the Order of Temporary Immediate Suspension by rescinded.
