June 24, 2026 - Petitioner established by a preponderance of the evidence that the ECRC materially erred due to its reliance on incorrect scoring of the Minnesota Screening Tool Assessing Recidivism Risk (MnSTARR-3.0). Because the ECRC erred, the Court conducted a de novo review of the record to determine the appropriate risk level assignment. Based upon that review and risk factors set forth in Minn. Stat. § 244.052, subd. 3(g), Petitioner is assigned to a Risk Level 1.
