25-2001-40813 In Re Farmed Cervidae Fencing Cases

April 14, 2026 - The Administrative Law Judge recommends that the Commissioner AFFIRM the civil penalty issued to each Respondent. The Department properly found each farm’s fence did not prevent physical contact between farmed Cervidae and free-roaming Cervidae as required by in Minn. Stat. § 35.155, subd. 4, and those determinations were not arbitrary or capricious. The $500 penalty is authorized and reasonable. However, if the Department finds that Mr. Huju’s new fence is compliant, the Department should consider reducing or rescinding his penalty.
