80-1900-30852 In the Matter of the Proposed Rules of the Department of Labor and Industry Governing Radon Gas Mitigation Control Methods in Residential Buildings and the Minnesota Residential Energy Code, Minnesota Rules parts 1303.2400-1303.2403 and 1322.0010-1322.2400 June 11, 2014 - 1. The Department has the statutory authority to adopt the rules. 2. The rules were adopted in compliance with the procedural requirements of Minnesota Statutes, Chapter 14, and Minnesota Rules, Chapter 1400. 3. The Department amended Parts 1322.0402, subpart 1 and 1322.0500 in its proposed rules as published with the Notice on the Department’s website. The amendments were made in response to public comments. Neither amendment causes the rule to be substantially different under Minn. Stat. § 14.05, subd. 2, from the proposed rule as published with the Notice on the Department’s website. 4. The record demonstrates the rules are needed and reasonable. 5. The rules are APPROVED.
