Rulemaking: Commemorative Works on the Minnesota Capitol Grounds

UPDATE - Revised Rules governing commemorative works on the Minnesota Capitol grounds took effect on November 21, 2022. Information on the application process to request consideration of adding a new work or modifying or removing an existing work is available on the Applications webpage.

The Capitol Area Architectural and Planning Board approved the Order to Adopt amendments to MN Rules Chapter 2400 on August 24, 2022. The amendments update the process and standards by which the CAAPB reviews public requests for the addition of new works on the Capitol grounds, and adds a process and standards for reviewing public requests to modify or remove existing works.

Commemorative Works Rulemaking

The CAAPB began evaluating its rules for commemorative works in June 2020. The key activities and information from the two-year rulemaking effort are featured below.

2. What is Rulemaking (and what is it not)?

Rulemaking is an important part of the State’s lawmaking process. State agencies with rulemaking authority use the process to implement laws they are responsible for under Minnesota Statute. Minnesota Statute 15B governs the Capitol Area Architectural and Planning Board, and the Board implements its responsibilities under Minnesota Rules Chapter 2400.

Rulemaking follows a specific process, designed to be transparent, open to public input, and subject to expert legal review. Read here for more information on the Rulemaking process.

This rulemaking process considers changes to MN Rules Chapter 2400 governing HOW proposals for commemorative works are made and reviewed by the Board. It does not involve any discussion or decisions about specific works already in the Minnesota Capitol collection.

The Statement of Need and Reasonableness (SONAR) explains why the proposed rules are needed and reasonable. The SONAR also describes who the rule will affect and estimates the rules probable costs.
