Debate over using restraint goes on in state's school

October 2023
By Access Press Staff

The use of restraints in Minnesota schools continues to stir controversy following a new state law placing limits on how students can be physically restrained. The law, part of the 2023 education bill, prohibits prone positions and comprehensive restraint on the head, neck, and most of the torso.

The changes, aimed at safeguarding students, have led to the removal of student resource officers (SROs) from many schools, with law enforcement agencies expressing concerns over restrictions. The Minnesota Attorney General, Keith Ellison, has issued legal opinions indicating that the law allows "reasonable" use of force in certain situations to prevent harm.

The debate over a special session and potential revisions to the law continues, with some law enforcement agencies allowing SROs to return to schools. The issue remains a focal point of discussions involving local officials, state lawmakers, and law enforcement leaders.
