Objections to Murphy v. Harpstead settlement are heard in federal court

A federal class action lawsuit, Murphy v. Harpstead, involving Minnesotans with disabilities and their living choices, particularly in group homes, is awaiting a decision after a fairness hearing at the St. Paul federal courthouse. Disability rights activists rallied to protest what they perceive as an inadequate proposed settlement.
The proposed agreement, reached through mediation, covers individuals aged 18 and older eligible for and receiving disability waivers, residing in licensed community residential settings, and not given the choice to live in the most integrated setting suitable for their needs.
The settlement, spanning nearly 40 pages, includes provisions requiring changes to MnCHOICES assessments, case manager tasks, and the Community Based Services Manual, aiming to inform individuals of their rights to explore alternative housing options.
