Administrative Law Subpoenas

A subpoena is an order from a judge to appear at a hearing or produce documents. If you get a subpoena and deliver it properly, the judge will require the person to appear.

A subpoena duces tecum requires a person to testify at the hearing and bring certain documents.

Requesting subpoenas

To request a subpoena, fill out the Subpoena Request Form.

Send the completed form to the judge assigned to your case at the Office of Administrative Hearings, PO Box 64620, St. Paul, MN 55164-0620, fax it to (651) 539-0310, or deliver it to 600 North Robert Street, St. Paul, MN 55101.

Send a copy of your request to each of the other parties participating in your case.

If you are requesting documents, describe the documents you want in detail. Be clear about the subject of the documents, the approximate date or date range, and the likely location of the records.
Cost

OAH charges $5.00 per subpoena. You may submit a check payable to the Office of Administrative Hearings with your request, or you will be billed for the subpoena.

You must pay each witness a $20.00 fee for the first day of the hearing, plus 28 cents per mile from the person’s home to the hearing and back.
Delivery

Service must be done properly to ensure that the judge can require the person to attend the hearing.
- An adult who is not a party to the case must deliver the subpoena and the required fee to the person or the home of the person you want to subpoena. You may pay a sheriff, deputy sheriff, or private company to deliver the subpoena for you.
- The subpoena and fee may be left with any responsible adult at the home address.
- The adult who serves the subpoena must prepare a written statement detailing exactly when, where and to whom the subpoena and fee were served. Provide the written statement to the judge to show that the subpoena was properly delivered. See the sample Certificate of Personal Service.
