September 20, 2024 - Complainant established that Respondents violated Minn. Stat. §§ 13.03, subd. 3(f), 13.04, subd. 3, 13.46, subd. 3, and 260E.35, by redacting data in their response to Complainant’s December 1 Request. Complainant has also established that Respondents violated Minn. Stat. §§ 13.04, subd. 3, 13.46, subd. 3, and 260E.35, by initially denying Complainant’s April 24 Request. Because there is a genuine uncertainty about the meaning of the governing statutes, Respondents are not assessed a penalty and Complainant is not entitled to an award of attorney fees related to the December 1 Request. Complainant is entitled to an award of attorney fees related to the redactions in the April 24 Request.
