February 16, 2024 - The Administrative Law Judge concludes that there are no issues of material fact regarding Appellant’s HCBS license application. The undisputed facts establish that Appellant failed to submit a substantially complete application, despite numerous opportunities to do so. Appellant’s inability to complete the application requirements also demonstrates that Appellant does not have competent knowledge of applicable licensing statutes and rules. Accordingly, the Department has valid legal bases to deny Appellant’s license application pursuant to Minn. Stat. § 245A.05(a)(1) and (8) (2022). Because there are no material facts in dispute, an application of the law to the undisputed facts renders summary disposition appropriate.
