21-1901-36432 Roslyn Robertson, Commissioner, Minnesota Department of Labor and Industry, Complainant, vs. U.S. Home Corporation d/b/a Lennar, Respondent

September 17, 2021 - The Administrative Law Judge concludes that Respondent failed to take precautions to prevent damage to liquefied petroleum gas (LP-Gas) systems from vehicular traffic, in violation of 29 CFR 1926.153(o). Complainant established by a preponderance of the evidence that the violation was serious and the penalty was calculated correctly. Respondent failed to establish that enforcement of the cited standard violates due process. The citation is AFFIRMED.
