65-1800-37265 In the Matter of the SIRS Appeal by Comfort Keepers

September 9, 2021 - The Department has established by a preponderance of the evidence that Appellant committed abuse in connection with the provision of medical services paid by public assistance. The evidence proves that Appellant: (1) submitted claims from which required information was missing or incorrect in the recipient’s health service record; (2) failed to develop and maintain health service records as required under Minn. R. 9505.2175; and (3) failed to disclose or make available to the Department the recipients’ health service records, as required by Minn. R. part 9505.2185. As a result, the Commissioner of the Department of Human Services (Commissioner) is entitled to seek recovery of overpayments in the amount of $55,789.95 and condition Appellant’s continued participation in the Minnesota Health Care Plan on the execution of a Stipulated Provider Agreement.
