July 31, 2020 - The Administrative Law Judge concludes that Respondents failed to timely complete the corrective actions required by the APO, and that the Department properly issued the Noncompliance Determination dated July 26, 2019. The Administrative Law Judge also concludes that the $10,000 administrative penalty was properly issued and that the $9,223 forgivable penalty is now due and payable. Finally, the Administrative Law Judge concludes that the Department’s decision to revoke the Respondent’s license was proper because Kobe Restaurant engaged in numerous serious and repeated violations of Minn. R. ch. 4626 (2019) (the Food Code).
