71-1902-39237 In the Matter of the Administrative Order Issued to Stacy Marie Roxberg and Triple S Company

January 29, 2024 - Respondents failed to appear at the hearing and, therefore, are in default. As a result, the Department’s allegations are accepted as true and deemed proven, and the relief requested by the Department may be granted. Moreover, the record offered by the Department establishes that Respondents acted or held themselves out as a residential building contractor or residential remodeler without being licensed by the Department, and they performed or offered to perform unlicensed electrical and plumbing work. Further, Roxberg violated the Commissioner’s 2020 Order by continuing to engage in unlawful conduct after being ordered to cease and desist and by failing to pay the penalty imposed. Her failure to pay the penalty also demonstrated financial irresponsibility. Finally, Respondents failed to comply with the Department’s requests for information. Therefore, the Administrative Law Judge recommends that the Administrative Order with Penalty issued February 28, 2023 (Administrative Order), should be AFFIRMED and should become a final order. The Administrative Law Judge further recommends that the Administrative Order should be AMENDED to include Triple S and the amended claims identified in the Department’s Amended Notice and Order for Hearing dated September 7, 2023 (Amended Notice and Order).
