November 26, 2018 - The Administrative Law Judge concludes that the Police Department’s use of the code “cleared by arrest” in the Incident Report makes that document inaccurate and incomplete under the Minnesota Government Data Practices Act (Act).1 The Administrative Law Judge recommends that the Commissioner of the Department of Administration (Commissioner) order the City to (1) delete the “cleared by arrest” designation from the Incident Report; (2) amend the Incident Report to a more appropriate clearing code; and (3) notify any persons or entities that have received the Incident Report that the “cleared by arrest” designation has been deleted and that the Incident Report has been amended.
