April 19, 2023 - With few exceptions, ACC’s business, caregiving and accounting practices were consistent with sound fiscal, business, or health service practices, and did not result in unnecessary costs to the MHCP. The Administrative Law Judge respectfully recommends that the Commissioner of the Department (Commissioner) MODIFY the Notice of Overpayment, by reducing the amount which ACC is required to repay from $389,165.31 to $10,652.64 and imposing fines of $5,700 for ACC’s other regulatory failures.
