August 23, 2019 - The Administrative Law Judge concludes that the Department has met its burden of proof regarding Visu-Sewer’s violation of 29 C.F.R. 1926.21(b)(2) and Minn. R. 5207.0720. The evidence, however, established these violations were serious, not willful. The Administrative Law Judge further concludes that the Department has failed to meet its burden of proving that Visu-Sewer violated Minn. R. 5207.0620. This citation is therefore reversed.
