5-1800-35012 In the Matter of the Appeal by William and Denise Muske of the Revocation of their Child Foster Care License and the Disqualification of William Muske

July 20, 2018 - The County did not properly determine that William Muske was responsible for maltreatment. There was not a preponderance of evidence to make a determination that sexual abuse occurred. As a result, there is no basis for his disqualification and the determination that the alleged maltreatment was serious. Further, William Muske does not pose a risk of harm to children served by the foster care program. The private licensing agency, EVOLVE, did not conduct an investigation and so could not correctly determine that Appellants committed licensing violations. Finally, based on the above conclusions, the Department did not properly revoke Appellants’ foster care license and the revocation should be RESCINDED.
