19-1800-34647 In the Matter of the Appeal of the Order to Pay a Fine and Order of Conditional License of the Family Child Care License of Connie Cotterman

February 6, 2018 - Based on the evidence in the hearing record, the Administrative Law Judge recommends that the Commissioner find that the Department demonstrated reasonable cause to issue its Order to Pay a Fine and Order of Conditional License. Appellant failed to prove she was in full compliance with the violations of statute and rule the Department alleged. The preponderance of the evidence is that Appellant failed to follow sudden unexpected infant death reduction requirements on January 11, 2017, for which a $200 fine is appropriate. The preponderance of the evidence is that Appellant committed violations of child care requirements of sufficient severity that Commissioner may appropriately issue the Order of Conditional License.
