Rulemaking Comments

OAH's Administrative Law Judges review the need for and reasonableness of all rules proposed by state agencies. Interested members of the public can comment on proposed rules pending at OAH.

eComments

OAH hosts a centralized rulemaking eComments website to enable the public to better participate in an efficient and open rulemaking process.

The rulemaking eComments website allows the public to:

  • Find rulemaking matters open for comment
  • Download an agency’s rulemaking materials (e.g. proposed rules, applicable public notices, the agency’s Statement of Need and Reasonableness, and related exhibits)
  • Review comments submitted by the public on pending rulemaking matters
  • Submit comments on pending rulemaking matters

Important: All comments will be made available to the public. Please only submit information that you wish to make available publicly. The Office of Administrative Hearings does not edit or delete submissions that include personal information. We reserve the right to remove any comments we deem offensive, intimidating, belligerent, harassing, bullying, or that contain any other inappropriate or aggressive behavior without prior notification.

Public Comment Portal Project

OAH is leading an enterprise-wide project to build a ne accessible, easily-navigated, web-based public comment portal for Minnesota that increases opportunities for outreach and engagement and simplifies business processes in rulemaking. The new public comment portal will replace the current eComments system.

Funding

In 2021, six state agencies contributed $350,000 to an Odyssey fund the project discovery phase.

In the 2023 legislative session, OAH received one-time funding of $1.8M from the general fund to:

  1. Build the rulemaking public comment portal; and
  2. Update OAH's internal case management system to support future integration with the portal.

Project schedule

The new comment portal is expected to go live by the end of 2024.
