Fuel Tax Labeling

During the 2017 legislative session, a provision was added to Minnesota Statute Chapter 239 requiring the Minnesota Commerce Department Weights & Measures Division to ensure that signs are posted on retail petroleum dispensers showing the current state and federal taxes for gasoline and diesel fuel.

Commerce Weights & Measures has created adhesive labels (see below) with the appropriate wording, in the appropriate font size, for gas and diesel dispensers. The labels are 2.25” x 2”, with black lettering on a white background. Labels should be placed on each face and in the upper two-thirds of the dispenser. They should be placed in a location where they will not be removed if the dispensers are refaced

  • If a pump dispenses gasoline, it will need a label showing the tax on gasoline. 
  • If a pump dispenses diesel, it will need a label showing the tax on diesel. 
  • If a pump dispenses both gasoline and diesel, it will need both labels.
  • Pumps dispensing only ethanol blends of 20% or more, E85 or CNG do not require a label.

When conducting their routine inspections, Commerce Weights & Measures inspectors will be applying these labels to dispensers. However, if you do not want to wait until an inspector comes to your location, you have these two options:

  • Complete the online form to request labels. Commerce Weights & Measures will mail you the number of labels you requested and you can then apply the labels yourself; or
  • Print your own labels/signs and put them on your dispensers. However, you must follow these requirements:
    • The labels/signs must be printed in 12-point or larger type font.
    • The labels/signs must contain the exact wording below:
      • For gasoline: The price for each gallon of gasoline includes the current state gasoline tax of 28.5 cents per gallon and federal gasoline tax of 18.4 cents per gallon. Revenue from the state fuel tax may be used only for roads and bridges, according to the Minnesota Constitution.
      • For diesel: The price for each gallon of diesel fuel includes the current state gasoline tax of 28.5 cents per gallon and federal gasoline tax of 24.4 cents per gallon. Revenue from the state fuel tax may be used only for roads and bridges, according to the Minnesota Constitution.
    • You may use colors that match your branding, but you must use contrasting colors for the text and background.
