Many vendors can supply labels that bring you into compliance with the mandate.

For blends containing between 5% and 20% biodiesel, use the following labels:

The Federal Trade Commission (FTC) regulates labeling for fuel dispensers.

• Dispensers selling blends containing between 5% and 20% biodiesel must be labeled as either BIODIESEL BLEND or B20 BIODIESEL BLEND.  
• Dispensers selling blends containing more than 20% must be labeled “Bxx.”

Consider the cost of labeling requirements when deciding to whether to exceed to minimum biodiesel content requirement from October – March. If you choose to keep you biodiesel content between 5% and 20%, you can keep the BIODIESEL BLEND label on the dispensers all year long. All retailers must label their dispensers as either BIODIESEL BLEND or as B20 BIODIESEL BLEND when the fuel contains between 5% and 20% biodiesel.

The minimum biodiesel content in diesel fuels required by Minnesota Statute has changed to 20%. The Weights and Measures Division of the Minnesota Department of Commerce wants to help you understand this change.

• For the months of October – March, diesel must contain at least 5% biodiesel.
• From April 1st - 14th, diesel must contain at least 10% biodiesel.
• From April 15th – September 30th, diesel must contain 20% biodiesel.
• #1 diesel is exempt from the biodiesel requirement year round.
• The amount of biodiesel required in a #1/#2 blend will depend upon the blend ratio of the two products and the required bio content of the #2 diesel during that time of the year.

The ONEOK/Magellan terminal located in Rochester, MN has notified the Minnesota Department of Commerce Weights and Measures Division that the terminal does not have biodiesel available for loading at the rack between 12:45 pm, February 13, 2025, and 12:15 pm February 23, 2025.

Retailers may be granted a waiver under  Minnesota Statutes §239.80 on diesel loads bought from ONEOK/Magellan terminal in Rochester, MN during the biodiesel outage if:

1. The retailer, or its purchasing agent, was already an existing customer of ONEOK/Magellan terminal in Rochester, MN at the time of the biodiesel outage; 

2. The retailer is obligated to meet the  requirements of Minnesota Statutes §239.77 because the retailer sells diesel fuel for use in internal combustion engines;  and 

3. The retailer had insufficient time to arrange for alternative sources of biodiesel to meet statutory requirements. 

The Weights and Measures Division will determine a retailer’s eligibility for this waiver through bills of lading or other information obtained by the Weights and Measures Division from the retailer and from ONEOK/Magellan terminal Rochester, MN under the auditing authority granted in Minnesota Statutes §§239.011, 239.75, and 239.753.   

This waiver applies only to loads pulled from the ONEOK/Magellan – Rochester, MN terminal between 12:45 pm, February 13, 2025, and 12:15 pm February 14, 2025.

Diesel sold for use in combustion engines under any conditions other than those outlined in a waiver granted by the Weights and Measures Division must have the minimum amount of biodiesel required under Minnesota Statutes §239.77, or retailers may face penalties under Minnesota Statutes §239.80.

1. The retailer, or its purchasing agent, was already an existing customer of ONEOK/Magellan terminal in Rochester, MN at the time of the biodiesel outage; 

2. The retailer is obligated to meet the  requirements of Minnesota Statutes §239.77 because the retailer sells diesel fuel for use in internal combustion engines;  and 

3. The retailer had insufficient time to arrange for alternative sources of biodiesel to meet statutory requirements.

1. The retailer, or its purchasing agent, was already an existing customer of ONEOK/Magellan terminal in Alexandria at the time of the biodiesel outage; 
2. The retailer is obligated to meet the requirements of Minnesota Statutes §239.77 because the retailer sells diesel fuel for use in internal combustion engines; and
3. The retailer had insufficient time to arrange for alternative sources of biodiesel to meet statutory requirements.

The Weights and Measures Division will determine a retailer’s eligibility for this waiver through bills of lading or other information obtained by the Weights and Measures Division from the retailer and from ONEOK/Magellan terminal Alexandria under the auditing authority granted in Minnesota Statutes §§239.011, 239.75, and 239.753.
