WCCA Rulemaking Docket

Minnesota Statutes, Chapter 14.366 requires each agency to maintain a current, public rulemaking docket. This section lists the pending rulemakings under consideration. The status of each rulemaking will be updated as we proceed. All documents, including any written requests for a public hearing will be available here.

 Proposed Permanent Rules Governing Workers’ Compensation Court of Appeals Rules of Procedure, Minnesota Rules, Chapter 9800; Revisor’s ID Number R-04804

Subject Matter: Amending the existing rules governing workers’ compensation appeals and petitions to vacate to conform those rules to amendments to Minnesota Statutes, chapter 176, the Worker’s Compensation Act.  The proposed rules will incorporate electronic filing and service through the CAMPUS system managed by the Minnesota Department of Labor and Industry to make filing and service easier for all persons involved in matters before the WCCA.

Comment Period: Comments on the proposed rules can be made until Friday, November 22, 2024, as set out in the Notice of Intent to Adopt Rules available at the link below. Comments will be posted on this website as they are received.

Status: The Notice of Intent to Adopt has been published in the September 23, 2024, edition of the Minnesota State Register and is available at the link below. The rule is proposed for adoption without a public hearing unless a sufficient number of persons request a hearing. Hearing requests must be in writing, include your name and address, and identify the portion of the proposed rules that you object to or state that you oppose the entire set of rules. Hearing requests can be submitted through the OAH discussion board at: https://minnesotaoah.granicusideas.com/discussions/39472-minnesota-workers-compensation-court-of-appeals-dual-notice-of-intent-to-adopt-rules or directly to the court at:
