Mandated Reporter - School District Ethics Guidance

Pursuant to Minnesota Statutes section 122A.20, subdivision 2(a), a school board, superintendent, charter school board, charter school executive director, or a charter school authorizer must report to the Ethics Department of PELSB when, generally:

  1. A teacher is discharged/terminated for misconduct
  2. A teacher resigns due to misconduct
  3. A teacher retires due to misconduct
  4. A teacher is non-renewed for misconduct
  5. A teacher is given an unpaid suspension for misconduct
  6. A teacher is criminally charged with an automatic-revocation offense
  7. A teacher resigns while an investigation into their misconduct is pending

This mandated report must be submitted to the Ethics Department of PELSB within ten days after the triggering event which requires the report.

The report should be sent electronically to the Ethics Department and can be relatively short, but must include:

  1. The teacher's name
  2. The teacher's file folder number
  3. The date of the action taken against the teacher requiring the mandatory report

SAMPLE: "Pursuant to Minnesota Statutes section 122A.20, I am reporting John Doe, FF# 12345932, for misconduct. The district issued a 10-day unpaid suspension for inappropriate communication with students on June 1, 2020."

Once the district's mandatory report is received and opened, the Ethics Department will follow up with a data request which includes a series of questions and a request for the underlying district investigation documentation/audio/video materials. Districts and charter schools are required to comply with the Ethics Department's data request. The data must be submitted digitally to the Ethics Department via the contact information noted above. If sending a large amount of data via filesharing application, please ensure that all data is downloadable from the storage source.

A district or charter school is statutorily obligated to continue to update the Ethics Department with additional documents as they receive them and must supplement their data response as necessary.

While the Ethics Department cannot provide real time updates about the status of any case, the mandated reporter will be notified when the matter is closed and any publicly available data will be disseminated at that time.
