AFSCME 65 petitioned the Bureau for clarification or amendment of an appropriate unit. The petition requested clarification of the public employee status of certain employees of Stearns County. The Bureau found that an employee would have been a public employee within the meaning of Minn. Stat. 179A.03, subd. 14, had he not separated employment with the Employer on October 30, 2020. The Bureau also determined another employee question was moot due to the accepting the full-time position with the employer on January 6, 2021. Additionally, it was decided that a group of individuals did not meet the definition of a public employee in the accordance with Minn. Stat. 179A.03, subd. 14.
