Decertification (Public & Private)

In order for employees to decertify a current exclusive representative it is necessary to file the following forms with the Bureau.

  1. A Petition for Decertification (online form, preferred)
  2. Valid Deauthorization Cards signed and dated by at least 30 percent of the employees included within the appropriate unit.


Upon receipt of all completed documents, an investigation will be initiated and if necessary a public hearing will be held to secure testimony and/or evidence pertinent to the request. If the petition is found to be valid and timely an election will be conducted by the Bureau to determine whether eligible employees within the appropriate unit in question wish to remain represented by the current exclusive representative. In order for an incumbent exclusive representative to be decertified, a majority of eligible employees who vote must cast ballots indicating that they no longer wish to be represented by the incumbent exclusive representative.
