Grievance filed after City unilaterally changed the seniority-based vacation selection process to allow opportunities for preferable vacation blocks to less senior staff. ER asserted no violation of contract language, previous policy changes were not grieved, and challenged timeliness of filing. Earlier hearing deemed issue arbitrable.         

Grievance Sustained      ER violated the contract when it unilaterally implemented a policy that had the effect of undermining or changing the language in the contract, as well as violated established past practice of vacation preferences based on seniority.
