Grievance filed after ER unilaterally reduced vacation and holiday accruals in CBA by converting them to ESST time required by statute. ER contends it only allowed for enhanced flexibility of use of existing benefits, an existing past practice.      

Grievance Sustained      ERs change is a violation of the contract with regards to vacation and holiday leave. Ordered to make whole any employee who had time reduced due to conversion to paid sick and safe time. ER also responsible to follow ESST law, though parties will have to negotiate what that looks like.
