Issue: Sick Leave Use              

EE denied use of paid sick leave for time taken beyond parental leave and ER charged time against unpaid compensatory time bank. Union argued request followed CBA language, and was approved in advance by supervisor. Time being used to care for children (not simply to bond). ER pointed out failure to provide medical documentation required to support sick leave request, and lack of past practice.

Grievance Sustained                 Contract does not limit right to use sick leave to “care for”  a child only when child ill or sick. Supervisor knew circumstances and reasons for the request and made decision to approve. Leave time classified as compensatory time shall be reclassified as sick leave, and compensatory time bank restored.
