Issue: Class Action Communication Past Practice

ER responded to changes within the MN Government Data Privacy Act by limiting the dissemination of protected private data via state emails or secured domains only. Previously information being sent to whatever email provided by union official to conduct official union business. Union asserted negatively impacted their ability to properly represent and respond.             

Grievance Sustained      No evidence of any previous inappropriate access or use of private information shared to union officials personal email accounts. Witnesses knowledgeable and trained on importance of data, use of redaction, etc. Change in policy because of hypothetical concerns do not outweigh the union's right to the information in the manner outlined in both PELRA and the CBA. Can protect the data via redaction prior to it being sent.

NOTE:  A Request for Clarification and to delete certain portions of the award was received and denied by the Arbitrator. The Ruling and discussion on that request is attached as an addendum to the original award.
