Issue: Arbitrability and Scheduling Past Practice
ER made union aware in April 2021 that 12 hr shifts in a particular unit would be posted with every other weekend scheduled, rather than every 3rd weekend. Union filed grievance in March 2022. ER said no language limits the Flexible 12 Hr bids from working every other and that the grievance was not timely.
Grievance Denied Arbitrator concluded that the Union's grievance of March 8, 2022 failed to meet the contractual grievance time frame requirements and was untimely filed.
