Working Foreman (and veteran) required to have CDL and operate all equipment was discharged after losing CDL as a result of a DWI. Union argued disparate treatment from other DWI occurrences, lax enforcement of CDL requirement, and ability (but refusal) to approve Ignition Interlock System agreement. Eligibility for CDL reinstatement in a year.     
 
Grievance Denied. Discharge upheld. Both contract and city policy make having a CDL a required condition of employment for his position. Previous staff DWI's have not had the same impact on CDL, grievant supervised and was responsible for those not obtaining their CDL upon employment, and there is no obligation for the city to agree to an IIS or find alternative work.
