Issue: 1. Suspension 2.Restricted Access
Grievant issued a 30-day suspension for violation of Workplace Conduct policy related to an encounter with a new female office manager in the breakroom. ER also restricted access to building A to prevent further interactions between the two. Union argued length of suspension excessive compared to previous disciplines issued, and for a longtime EE with limited previous discipline.
Issue 1: Denied Issue 2: Sustained ER had just cause to impose 30-day suspension. Lesser disciplines given for other violations of this policy involved 1:1 interaction. This occurred in front of a large number of other employees. However, isolation in the workplace is punitive and in violation of just cause and discipline articles in the contract. ER ordered to lift restriction preventing EE from entering building A, and allow him to begin and end his workday there.
