Issue: Alteration of Benefits       

Grievance filed after union discovered ER giving credit to new hires for prior experience in determining level of annual leave and longevity benefits rather than those outlined in contract. ER argued contract provides a floor and does not prevent them from offering benefits that exceed the CBA minimums.       

Grievance Sustained. ER ordered to cease and desist offering benefits that differ from the CBA without bargaining with the union, rescind the enhanced longevity benefits provided to new hires following the filing of grievance, credit all unit EEs who did not received offer of enhanced benefits an additional 40 hours of personal leave, subject to the maximum of 240 hours per year
