Issue: Overpayment and ULP
EE's shift change resulted in overpayment of overtime. ER attempted to work out re-payment plan directly with EE, until union representation requested and brought in. Grievance filed for directly communicating to the EE, threatening collections and an Unfair Labor Practice charge filed to NLRB.
Sustained in part. ER did not have written voluntary acceptance to change EE's work schedule. However, it did not actually recover the overpayment via salary deductions. It was noted this was an effort to correct an error, not an attempt to adjust the EE's rate of pay.
