Educational Assistant removed from remainder of summer term assignment after requesting use of paid leave time to leave country during the summer session. District argued summer term is not covered by the collective bargaining agreement. Separate S term policy manual clearly states that employees only paid for the days they actually work, and are hired with expectation they work the entire session.
Grievance denied. Should have clearly understood that he would not have been hired had the District had prior knowledge he was not available to work the entire session.
