The State of Minnesota Is Reviewing Cannabis Records The Adult-Use Cannabis Act was passed in Minnesota in 2023, making cannabis use legal for adults and creating the opportunity for the expungement of eligible cannabis (marijuana) charges.
The Cannabis Expungement Board (CEB) was created to review Minnesota felony cases and some misdemeanor and gross misdemeanor cases.
If You Have a Cannabis Misdemeanor If you have a past misdemeanor cannabis conviction, your record may already be expunged. The Minnesota Bureau of Criminal Apprehension automatically expunged approximately 57,000 cannabis-related records. You can go to Minnesota Court Records Online to see if your court record has been expunged.
If You Have a Cannabis Felony The Cannabis Expungement Board will review eligible felonies and some misdemeanor and gross misdemeanor cases. There are approximately 110,000 cases to be reviewed. These cases are not eligible for automatic expungement and require a more extensive review process that will take several years to complete.
The CEB is a state agency established by law in 2023 under the Minnesota Adult-Use Cannabis Act and governed by Minn. Stat. §609A.06. The CEB reviews eligible felony cannabis convictions or stays of adjudication for potential expungement or resentencing.
