A departure report form must be completed by the sentencing court when the court pronounces a sentence that is a departure from the presumptive sentence. This includes a stayed or imposed gross misdemeanor or misdemeanor sentence.
Departure reports must be filed with the Commission within 15 days after sentencing. Minn. R. Crim. P. 27.03, subd. 4(C).
