What are Competency Attainment Services?

Competency Attainment Services are defined in Minn. Stat. 611.41, subd. 6 as “education for defendants found incompetent to proceed by certified individuals using the approved curriculum…” The statute further defines that competency attainment services do not include mental health, substance use disorder, or co-occurring disorders treatment as provided by a licensed professional.

The Board created and approved its first statewide competency attainment curriculum in September 2023. The curriculum is available for use by community and correctional facility providers. Certified Competency Attainment Programs must ensure that defendants receive competency attainment services (education), as well as clinical services aimed at addressing the defendant's needs to attain competency.
