Rulemaking Process

This is the process the Department of Administration (Admin) will follow for updates to Ch. 1205.

Step 1:    The Data Practices Office (DPO) prepares suggested changes to the rules in an initial draft. (Finished 7/10/2025)

Step 2:    DPO seeks informal suggestions and feedback from stakeholders, including written comments, meetings, and listening sessions. (Tentatively 7/13/2025-10/10/2025)

Step 3:    DPO revises the initial draft and determines whether another round of informal feedback is needed.

Step 4:    Once all informal feedback is incorporated, Admin will publish a formal "Request for Comments" in the State Register, which triggers a minimum of a 60-day comment period.

Step 5:    Admin will publish the "Notice of Intent to Adopt Rules" in the State Register, which triggers a minimum of a 30-day comment period, and release the Statement of Need and Reasonableness (SONAR). The "Notice of Intent to Adopt Rule" may also include information about a rules hearing.

Step 6:    Rules Hearing. We anticipate that there will be a hearing on these rules. If a rules hearing is held, all members of the public and any government entity staff are encouraged to participate. After the hearing, the Administrative Law Judge will assess the legality of the proposed rule changes and issue an order.

Step 7:    Notice of Adoption. Only after the "Notice of Adoption" is published in the State Register will rule changes become final.
