Review Housing with Services Lodging License Exemption

Exemption
Businesses holding a Housing with Services (HWS) registration are exempt from lodging licensure for tenant units or apartments. 

To determine if your establishment holds a HWS registration, search the Health Care Facility and Provider Database

HWS registration is issued through the Licensing and Certification program of the Minnesota Department of Health, Health Regulation division.

Minn. Stat. § 144D.06 A housing with services establishment is not required to obtain a lodging license under Minn. Stat. Chapter 157 and related rules.

Licensing

A license is required for other services, including:

▪ Food and beverage services

▪ Swimming pool or spa pool, such as a therapy pool

▪ Non-resident lodging, such as guest rooms

Food and beverage establishments, public pools, and lodging establishments in Minnesota are licensed by different agencies.
